Who are we?
"We", "us" and "our" refers to Automated Collection Services Pty Ltd (ACN 144 738 796), trading as ACS Asset Management, and our related businesses.
We provide credit in our own right for some products. We also process applications, service loans and collect payments on behalf of other lenders, including Smile Right, Breeze Finance and Pay for Paws. When we act for a lender, that lender is the credit provider and is responsible for your loan and your credit reporting information, and its own privacy policy applies. We also handle any personal information we hold in line with this policy.
Our commitment to protect your privacy
We understand the importance of protecting your personal information. This Privacy Policy explains how we collect, use, disclose and manage personal information, including credit-related information.
We are committed to complying with:
- the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth), and
- other applicable privacy and credit reporting laws.
We also comply with Part IIIA of the Privacy Act 1988 (Cth) in relation to credit reporting information, as further described in our Credit Reporting Policy (Consumer Finance).
What is personal information
Personal information is information or an opinion about an identified individual or an individual who is reasonably identifiable.
This may include credit-related information.
Credit-related information (overview only)
We may collect and hold credit-related information in connection with consumer finance applications and accounts.
Credit-related information may include:
- identification information
- credit application details
- credit liability information
- repayment history information
- default information (where applicable)
- credit eligibility information obtained from credit reporting bodies
- information derived from credit reporting data
We use credit-related information to assess eligibility for finance and manage credit relationships.

Why we collect, hold and use your personal information
We collect, hold and use personal information for purposes including:
- assessing finance applications
- managing finance products and accounts
- verifying identity and preventing fraud
- complying with legal and regulatory obligations
- maintaining customer relationships
- where permitted, direct marketing (with opt-out options)
Automated Decisions
We use computer systems to help assess applications and manage accounts, both for our own products and for the lenders we act for. Some decisions are made automatically by these systems. In other cases, a system produces a result that our staff, or the lender's staff, rely on when they make the decision.
Personal information we use in these systems
- identity details, such as your name, date of birth, address and identity documents
- employment and income information
- living expenses and other financial commitments
- bank account transaction data, where you share your bank statements with us
- credit information from credit reporting bodies, including credit scores
- details of the finance you apply for, and your repayment history
- details of the purchase or treatment, and the merchant or practice
Decisions made automatically by a computer system
- verifying your identity electronically
- declining an application that does not meet basic eligibility requirements, for example being under 18 or not an Australian resident
Decisions where a computer system plays a substantial part
- assessing whether you can afford the repayments, including working out your income and expenses from your bank statements
- assessing your creditworthiness using credit reporting information and credit scores
- recommending whether to approve or decline an application, and the amount and term offered
- identifying possible fraud
- identifying accounts that are overdue, and reporting repayment history to Equifax

Disclosure of your personal information
We may disclose personal information to:
- prospective funders and financial intermediaries
- credit reporting bodies
- service providers assisting in administration, technology, printing or customer support
- insurers, lenders mortgage insurers or trade insurers (where applicable)
- professional advisers such as lawyers and accountants
- entities involved in managing or acquiring our business or finance portfolios
- authorised representatives nominated by you
- regulators or law enforcement where required or authorised by law
- your employer, referees or identity verification services where necessary
We will take reasonable steps to ensure any recipient handles personal information appropriately.
Credit reporting framework
We participate in Australia’s credit reporting system.

Access and correction of personal information
You may request access to the personal information we hold about you and request correction if it is inaccurate, out-of-date or incomplete.

Security of personal information
We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure.
Security measures include access controls, password protection, firewalls, restricted access to systems and staff confidentiality obligations.
Where your information is stored
We store most of the personal information we hold, including credit-related information, in Australia, using cloud services hosted in Australia.
Information stored or accessed outside Australia
Some of our service providers store or access personal information outside Australia. These include providers that:
- send SMS messages on our behalf. They hold your mobile number and the content of the messages we send you, which may include account, payment or repayment details.
- manage documents you sign electronically, such as a request to change your nominated bank account or an agreement to vary your loan contract. These documents may include your bank account details and the terms of your loan or of any variation.
- provide technical support or security monitoring for our systems. Their staff may access information from outside Australia while it remains stored in Australia.
These providers are likely to be located in the United States and other countries where our technology providers' support staff are based.
Before we disclose personal information to an overseas service provider, we take reasonable steps to ensure it handles the information in line with the Australian Privacy Principles. This includes contractual obligations on confidentiality, security, and using the information only to provide services to us.
We do not send credit reports, or credit information we obtain from Equifax, outside Australia.
Using government identifiers
We do not use government identifiers (such as tax file numbers) as primary identifiers and only use or disclose them where authorised by law.
Business without identifying you
In most circumstances it will be necessary for us to identify you in order to successfully do business with you, however, where it is lawful and practicable to do so, we will offer you the opportunity of doing business with us without providing us with personal information, for example, if you make general inquiries about interest rates or current promotional offers.
Sensitive information
We will only collect sensitive information about you with your consent. Sensitive information is personal information that includes information relating to your racial or ethnic origin, political persuasion, memberships in trade or professional associations or trade unions, sexual preferences, criminal record, or health.
How safe and secure is your personal information that we hold?
We will take a range of measures and reasonable steps to protect your personal information. Your personal information will always be stored in a secure environment. We may store your personal information in paper and electronic form. We will also take reasonable steps to protect any personal information from misuse, loss and unauthorised access, modification or disclosure.

- investigate it internally, and
